Terms of Use

The Website may be used by any person of eighteen years of age or older. A person using a dealer dashboard must in addition be authorised to act on behalf of the dealership concerned. By using the Website, the user represents that both conditions are satisfied.

JaanCar operates a vehicle listing and assessment platform. JaanCar is not the seller of any vehicle listed on the Website. The dealer in whose yard a vehicle is held is the seller, and the contract of sale, the price, the payment, the documentation and the delivery of the vehicle are matters between the buyer and that dealer.

Accordingly, a dispute concerning a vehicle is a dispute with the dealer. JaanCar will assist a buyer in contacting the dealer but is not a party to the contract of sale.

A listing reproduces the information supplied by the dealer. An assessment report records the results measured by JaanCar in respect of a specified vehicle on the date of assessment and in the condition in which the vehicle was presented. Both are provided as information to assist a decision, and neither constitutes a representation as to the future condition of the vehicle.

Neither a listing nor an assessment report constitutes a warranty. Where a warranty is issued in respect of a vehicle, it is issued as a separate document on its own terms, and only that document creates a warranty obligation.

• Listings must be accurate. The price, odometer reading, year of manufacture, ownership history and condition stated must correspond to the vehicle actually held.
• Only images owned by the dealer, or which the dealer is licensed to use, may be uploaded. Images belonging to another dealership must not be uploaded.
• Buyer enquiries must be answered lawfully. A telephone number received through the Website is provided for the purpose of that enquiry alone and must not be added to a marketing list, disclosed to any third party or sold.
• A vehicle must be withdrawn from the Website once it has been sold.

• Scraping, crawling or bulk copying the listings, the assessment data or the dealer directory.
• Submitting false enquiries, fraudulent bookings or automated form submissions.
• Misusing the telephone number of a buyer, including unsolicited marketing, disclosure to a third party, resale, or contact concerning any matter other than the vehicle enquired about.
• Impersonating a dealer, a dealership or JaanCar.
• Attempting to breach, overload or circumvent the security of the Website.

A dealer account is provided so that a dealership may publish and administer its own yard profile. JaanCar may suspend or terminate an account that is used in breach of these Terms of Use, and will state the reason for doing so.

A dealer may terminate an account at any time. Deletion of the account from within the dashboard removes the yard page, the listings, their images, the enquiries received against them and the sign-in credentials, with immediate effect and without any further request.

JaanCar is responsible for operating the Website honestly and with reasonable care. JaanCar is not responsible for the condition of a vehicle it has not assessed, for the statements or conduct of a dealer or a buyer, or for any decision taken by a user in reliance on a listing.

Where an assessment carried out by JaanCar is inaccurate by reason of its own default, JaanCar will remedy that assessment. Nothing in these Terms of Use excludes or limits any right available to a consumer under the consumer protection law of India.

These Terms of Use, and any matter arising out of or in connection with them, are governed by the laws of India. The courts at the registered office of JaanCar in Karnataka have exclusive jurisdiction.

Questions concerning these Terms of Use, and complaints or requests concerning personal data, may be raised with JaanCar through the contact channels published on the Website. The procedure for grievance redressal in respect of personal data is set out in the Privacy Policy.

Where these Terms of Use are amended, the date stated above is updated accordingly. Continued use of the Website after that date constitutes acceptance of the amended version.
